Disability Law OutlineThe United States government introduced a public act in 1990, known as Americans with Disabilities Act or ADA. Under this act any from of discrimination against disabled individuals is prohibited. The act leads to the regulation of the disability law. Here is a disability law outline which can help you understand this law in a better way. The enforcement of the disability law helps a disabled person against discrimination faced in the place of employment. It also helps them in the field of education, and also helps them gain access to the basic public services. To be protected under the ADA and the disability law a person must have a disability. The law also protects people with an association to a disabled person. Under the disability law a disabled person is defined as a person with a serious physical or mental impairment that can substantially limit his/her major life activities. A person with a history of such impairment is also considered to be disabled under the law. Also, persons who are perceived by others as impaired are considered disabled under the law. The disability law recognizes alcoholism as a disability; however it does not recognize any other forms of socially undesirable behavior as disability. Thus, social disorders like compulsive gambling, pyromania or a disorder of sexual behavior like transvestism or pedophilia are not considered as disability. The disability law and the ADA, lay stress on the fact that the disabled person' privacy has to be maintained and respected. The law also requires that in the field of employment, education or public service a reasonable accommodation should be made available for the disabled persons to provide them with equal opportunities as a normal person. The law also includes a fair housing act, under which it is prohibited to discriminate a disabled person in any aspect of renting, or selling housing facilities. Another act included in the law is the Rehabilitation Act that prohibits any discrimination in the rehabilitation programs offered by the Federal agencies. Also included is the Air Carrier Access Act, which prohibits any discrimination against the qualified individuals with a physical /or mental impairment. The final act under the law is the Disabilities Education Act that requires that the public schools should be made available to all eligible children with disability. There are two agencies or departments that keep a check on the enforcement of the disability laws. They are the Department of Justice and the Equal Employment Opportunity Commission (EEOC). These agencies can be contacted in all states be it, Maine, Pennsylvania, New York, New Jersey or Texas.
